1. Acceptance of Terms
By downloading, accessing, or using the LocalMatch App ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. LocalMatch reserves the right to modify these Terms at any time. Your continued use constitutes acceptance of updates.
2. User Eligibility
- You must be 18 years of age or older to use the App
- You must be a legal resident of your country of access
- You are responsible for maintaining the confidentiality of your account credentials
- You may not register multiple accounts to circumvent restrictions
3. User Accounts & Responsibilities
Account Creation:
- You must provide accurate, complete, and current information
- You are responsible for all activity under your account
- You may not share your account with others
- You must notify us immediately of unauthorized access
Account Suspension or Termination:
We may suspend or terminate your account if you violate these Terms, provide false information, engage in harassment/fraud/illegal activity, violate IP or privacy rights, or exceed acceptable use limits.
4. Code of Conduct
Prohibited Behavior:
- ❌ Harass, abuse, or threaten other users
- ❌ Share false or defamatory content
- ❌ Engage in discrimination based on race, gender, religion, etc.
- ❌ Solicit money or engage in pyramid schemes
- ❌ Share illegal substances or services
- ❌ Hack, scrape, or reverse-engineer the App
- ❌ Share sexually explicit or violent content
- ❌ Impersonate others or misrepresent your identity
Consequences:
Violations may result in immediate account suspension, removal from games, forfeiture of fees, reporting to law enforcement, or permanent ban.
5. Games, Fees & Cancellations
Game Hosting:
Hosts are responsible for venue safety and compliance with local laws. Cancelling games with <4 hours notice may affect your reliability rating.
Game Joining:
Players agree to show up on time. No-shows and cancellations with <4 hours notice impact your reliability rating. 3 no-shows = account warning.
Liability for Injury:
LocalMatch is NOT liable for injuries, accidents, or damages during games. Users participate at their own risk.
6. Intellectual Property
Our Content: All App content (design, code, images, text) is owned by LocalMatch. You may not reproduce, distribute, or modify without permission.
Your Content: You retain ownership of content you upload but grant LocalMatch a license to display and analyze it. You are responsible for ensuring your content doesn't violate others' rights.
7. Disclaimers & Limitations
"As-Is" Service: The App is provided "AS IS" without warranties, including merchantability, fitness for purpose, or error-free operation.
Limitation of Liability: LocalMatch is NOT liable for indirect, incidental, or consequential damages. Our liability shall not exceed fees paid in the last 12 months.
Assumption of Risk: You assume all risks related to using the App, meeting users, and participating in games.
8. Payment & Billing
Payment Processing: LocalMatch does not process payments directly. All payments are arranged directly between players.
Refund Policy: LocalMatch handles no payments and therefore processes no refunds. Disputes between players should be resolved directly.
9. Privacy & Data Protection
Your use is governed by our Privacy Policy. By using the App, you consent to our data practices.
10. Dispute Resolution
Informal Resolution: Before pursuing formal action, attempt to resolve disputes by contacting us.
Binding Arbitration: Disputes shall be resolved by binding arbitration under India law, except claims under ₹250,000 may be brought in small claims court.
Class Action Waiver: You agree not to participate in class actions or collective proceedings.
11. Indemnification
You agree to indemnify LocalMatch, its officers, and employees from any claims, damages, or liabilities arising from your use of the App, violation of these Terms, violation of any law, or infringement of others' rights.
12. Governing Law
These Terms are governed by the laws of India, specifically Tamil Nadu (Coimbatore jurisdiction), without regard to conflict of law principles.
